Negligence is the failure to exercise the degree of care expected of a person of ordinary prudence in like circumstances in protecting others from the foreseeable and unreasonable risk of harm in a particular situation. To prevail in a negligence, claim, a plaintiff must prove four elements:

Duty of Care

The first element of proving negligence is showing the defendant owed the plaintiff a legal duty of care. All drivers in the state of Florida are expected to operate their motor vehicle in a reasonably prudent manner, i.e abiding by all traffic signals, driving the speed limit and showing due care for other drivers.

Breach of Duty

At all times, people and businesses have a duty to act with reasonable care. For example, if a person violates a specific statute and injures someone, they have committed negligence. Once a duty has been established, it must be shown that the defendant has breached that duty. The standard of care varies depending upon the cause of action. Our attorneys can provide guidance and legal counsel to help determine whether the case is valid and the best way to pursue the case.

Causation

In every personal injury case, causation is a core component. When a Plaintiff files a negligence claim, he or she must be able to prove that the defendant’s breach of duty caused the claimed injuries. The basic test for establishing causation is the “but-for” test, in which the defendant will be liable only if the claimant’s damages would not have occurred “but for” his or her negligence.

Damages

The final element of proving negligence is showing the Plaintiff suffered damages. There are 4 types of damages: past and future economic damages and past and future non-economic damages. Economic damages are damages of a determinable sum, i.e medical bills, and loss of earnings. Non-economic damages are less concrete and include pain and suffering, loss of enjoyment of life and mental anguish.
