About the Firm

The Law Firm of Williams and Yoho, P.A., is a Clay County-based Personal Injury Law Firm dedicated to those who have received injuries that were caused by another person’s negligence. Our attorneys have built a reputation for successful, straightforward representation, and outstanding client service. At our firm, you can be confident that you will receive the time and attention you deserve. We strive to do everything possible to alleviate as much of the burden off your shoulders as possible, so you can focus on recovering from your injuries and emotional trauma without having to fight legal proceedings alone.

Why should you consider hiring a Personal Injury Attorney?

  • You need to be able to focus on your injuries and seek the appropriate medical attention
Personal Injury cases can be time-consuming and confusing. If you’ve suffered injuries, you need to be able to focus your time and energy on getting better. With our experience and network, we can help assure that you get to the right doctors, so you receive an accurate diagnosis for your injuries, while also receiving the best treatment. Our goal is to ensure that our clients are on their road to recovery as quickly as possible.
  • Insurance companies do not have your best interest
Insurance companies and adjusters are very difficult to deal with, and they attempt to pay the least amount of compensation possible for your claimand will tell you that their offer is a fair settlement. Insurance adjusters are trained, paid, and encouraged by Insurance Companies to minimize the value of the claim. Insurance Companies purposely fail to consider pain and suffering, the true extent of injuries, future cost of medical treatment and all other costs that an experienced attorney would advocate for. To the untrained eye an initial offer coming directly after an accident of thousands of dollars may seem tempting to accept, however these are baseless offers that the insurance company knows represents only a fraction of what your claim is actually worth.
  • Proving your case
Oftentimes, the cause of an accident isn’t always clear. Liability may be disputed, and the other party may even try to blame you for the accident. Negligence is a key factor that forms the framework of fault in personal injury claims and lawsuits. To achieve success in a negligence case, the injured person must prove the following four elements: Duty of Care, Breach of duty, Causation and Damages.
  • Peace of mind
After an accident, many people ask themselves if they should call an attorney or just try and handle the claim themselves. An accident can alter your life in an instant and may present you with a new set of challenges and stress that can be too much to handle on your own. Our attorneys have years of experience working with victims who have been injured by the negligence of others. By entrusting your case to us, you can be confident we will fight for you to receive the compensation you deserve.
Negligence is the failure to exercise the degree of care expected of a person of ordinary prudence in like circumstances in protecting others from the foreseeable and unreasonable risk of harm in a particular situation. To prevail in a negligence, claim, a plaintiff must prove four elements:

Duty of Care

The first element of proving negligence is showing the defendant owed the plaintiff a legal duty of care. All drivers in the state of Florida are expected to operate their motor vehicle in a reasonably prudent manner, i.e abiding by all traffic signals, driving the speed limit and showing due care for other drivers.

Breach of Duty

At all times, people and businesses have a duty to act with reasonable care. For example, if a person violates a specific statute and injures someone, they have committed negligence. Once a duty has been established, it must be shown that the defendant has breached that duty. The standard of care varies depending upon the cause of action. Our attorneys can provide guidance and legal counsel to help determine whether the case is valid and the best way to pursue the case.

In every personal injury case, causation is a core component. When a Plaintiff files a negligence claim, he or she must be able to prove that the defendant’s breach of duty caused the claimed injuries. The basic test for establishing causation is the “but-for” test, in which the defendant will be liable only if the claimant’s damages would not have occurred “but for” his or her negligence.

The final element of proving negligence is showing the Plaintiff suffered damages. There are 4 types of damages: past and future economic damages and past and future non-economic damages. Economic damages are damages of a determinable sum, i.e medical bills, and loss of earnings. Non-economic damages are less concrete and include pain and suffering, loss of enjoyment of life and mental anguish.
